The Ghanaian band Alabaster Box has charged that hip-hop artist Medikal used parts of their hit song without obtaining authorization.
The Alabaster Box stressed that Medikal should have sought approval prior to incorporating parts of the track 'Akwaaba' into his latest release, 'Welcome to Africa'.
It remains unresolved whether Medikal should compensate Alabaster Box for using portions of 'Akwaaba' without permission.
The Alabaster Box has not yet determined if Medikal should be held responsible for compensation since he violated copyright laws and the group was not involved in the process of creating the song’s sample version.
Copyright infringement thus happens under these conditions: "(a) the work is displayed for profit, (b) the work is distributed, (c) the work is reproduced, excerpted, and copied for commercial purposes."
If someone violates a copyright, Act 690 from 2005 offers these options: "The copyright holder might (a) request the copyright administrator to resolve the disagreement via arbitration, (b) initiate criminal charges against the violator. Upon conviction, the perpetrator must pay a penalty. Additionally, (c) they have the option to file a lawsuit seeking an order to halt the ongoing violation."
Nevertheless, the group asserts that Medikal used samples from their hit song 'Akwaaba' without obtaining authorization.
The initial 10 seconds of 'Welcome to Africa' bear a strong resemblance to the opening segment of 'Akwaaba,' indicating potential direct copying as well as deliberate usage.
The collective contended that incorporating 'Akwaaba' into both the title and verses of Medikal's track demonstrates evident familiarity with their material.
The claim suggests that Medikal actively promoted and disseminated the supposedly infringing song on prominent streaming services such as YouTube, Audiomack, Spotify, Apple Music, andBoomplay, thereby exacerbating the infringement.
Via their attorneys, Alabaster Box has made an official request for the prompt removal of 'Welcome to Africa' from every digital and conventional platform.
The collective is calling for an immediate halt to all promotional, performance-related, and sales activities connected to the song. They are also insisting on canceling any agreements tied to its creation and dissemination.
Aside from ceasing all promotional efforts, the organization is asking for a comprehensive financial report detailing the earnings derived from the song. They also seek the identification of every individual or entity that was part of promoting or distributing it.
If their requests are not fulfilled, Alabaster Box plans to take legal action, seeking a court order to prohibit any further usage and to have all existing copies of the song destroyed.
They are pursuing financial reimbursement for unauthorized usage and further damages due to what they characterize as deliberate copyright violation, coupled with the recuperation of their legal costs.
Neither Medikal nor his team have officially addressed the accusation.
